This document is our Privacy Policy which governs how we collect and use personal information from visitors and website users.  This is a legally binding agreement, so please take the time to read these terms.  Our Terms of Service, policies, and guidelines supplement our Privacy Policy. This Policy applies to all visitors and customers of our website, platform, social media sites, and app.

  • Cookies: A program within your computer browser or websites to track a user's viewing habits. Cookies collect information such as: ISP; analytics; and viewing history.
  • EMS: Electronics Manufacturing Services.
  • GDPR: General Data Protection Regulation established by the E.U. (European Union) to help protect individual identity and information which becomes effective May 2018.
  • Non-Personally Identifiable Information: Data collected from visitors and users when they visit the website, such as analytics; ISP; and marketing data. This information is collected in order to improve how visitors and users access and use our website.
  • OEM: Original Equipment Manufacturer. Collectively, OEMs and EMS are known as "users" or "customers" within our Privacy Policy.
  • Personally-Identifiable Information: Information collected that is applicable to an individual user or visitor such as: name; email address; and contact information.
  • Terms of Service: Provisions and terms governing our business relationship with visitors and users.


Information and data we collect from users and visitors may be used in the following manner:

  • To personalize a user's experience and respond to Customer Service Inquiries and Requests;
  • To improve the navigability of the website;
  • To keep visitors and users' information on website updates; changes to our Terms and Policies; promotions and sales; and how to use and navigate our website;


Personally-Identifiable Information. We collect Personally-Identifiable Information for only legitimate business activities. The information collected from users may include: name, address, phone, and email address; which is necessary for our company to conduct business. This information is retained and used to identify customers and users; respond to customer service inquiries; as well as advertising and marketing purposes. For visitors that reside in California or the E.U., our Company will do our utmost to comply with local privacy laws and rules.

Web Server Log Information. Our Company uses a third-party server to host our website. Their privacy policies supplement our policies and guidelines.

Web Server Log Information. Our Company does not access log data from our website server: Our third-party hosting provider collects and stores server logs to ensure network and I.T. security to protect servers and the website. This includes and is not limited to: analyzing log files to help identify and prevent unauthorized access to our network; the distribution of malicious code; denial of service; and other cyber-attacks; by detecting unusual or suspicious activity.

COPPA and Sensitive Data. Our Company does not knowingly collect any information regarding children nor do we collect sensitive personal information. We request that you do not send us any sensitive information or data regarding children.

Personal and Non-Personal Identifiable Information. When you send an email to our Company, or an inquiry to an email address displayed on our website, we collect your email address and any other information you voluntarily provide within that communication.

Information Sharing. Information collected is used internally for marketing and advertising purposes. Your personal information is only accessed by our Company's owners; employees; and staff.

Privacy Policy Changes. We may decide to change or modify our Privacy Policy at any time.  In the event our Privacy Policy is amended, our Company will notify users and visitors via notices displayed on our website along with an effective date. Your continued use of our website is your acknowledgement and agreement with those changes.

Information Retention. Our Company retains user information for up to three (3) years after your personally acquired information is collected. At the end of this retention period, user records are deleted unless the user keeps their account in an active state otherwise, files will be permanently deleted from our system. Once files are deleted, the user acknowledges we will be unable to answer inquiries or requests for information regarding the user's account.

Criteria for Determining Retention Periods. Under normal circumstances, we will retain your information for no longer than necessary taking into account: whether we have a legal obligation to retain records; the value of the data or information being retained; risk levels; industry practices; relevant surrounding circumstances.


Sales and Special Offers. When a user or visitor sends us an email; completes a request for more information; or otherwise contacts they are giving us written permission to send them promotional email messages related to sales or special offers; responses to requests for more information; or customer support email messages.

How to Stop Promotional Emails. Users can stop receiving promotional emails by clicking the "unsubscribe" link in the bottom of each email message.  Upon receipt of the "unsubscribe" request, users will no longer receive promotional or marketing emails.


A “Cookie” is a small file stored within your computer's browser that allows companies to track visitor viewing habits. Our Company uses cookies to collect information for marketing and analytical purposes.

Third-Party Cookies. Users understand and agree that our Company has no control over information third-parties may collect regarding your personally-identifiable information, including but not limited to information collected through cookies. 

Opt-Out of Cookies. Users and visitors can opt out of cookies at any time by changing their browser’s security settings although this may affect how they use, access and view websites.

Alternately, if a User or Customer refuses cookies they can send a "Do Not Track" request to our Customer Service Department at:  Upon receipt of your "Do Not Track Request", we will make sure any new personally-identifiable information collected about you will not be used for a targeted marketing campaign.


FindanEMS.COM uses technical and state-of-the art methods to secure user information and to protect it against unauthorized or unlawful use and accidental loss or destruction including but not limited to:

  • Sharing and providing access to your information to the minimal extent necessary, subject to confidentiality restrictions where appropriate, and on an anonymous basis wherever possible;
  • Using secure servers to store your information;
  • Verifying the identity of any individual who requests access to information;
  • Using Secure Sockets Layer (SSL) software to encrypt any information you submit to our Company via any form through our website;

Email Transmission.  Transmission of information over the internet is not secure, therefore there is no presumption of confidentiality. Any information transmitted to our Company over the internet (i.e. via email, our website or any other means), you acknowledge and understand it is at your own risk.

Limited Liability. The user understands and agrees that our Company will not be responsible for any: costs; expenses; loss of profits; harm to reputation; damages; liabilities; or any other form of loss or damage suffered by you or a third-party as a result of accessing or using our website; or transmitting/submitting data to our Company by any such means.


Subject to certain limitations, you have the following rights in relation to your personal information, which you can exercise by sending a written request to our Company via email at: Your rights to access personal information includes and is not limited to:

  • Requesting access to your information, as well as how we use or process your information;
  • Requesting your information be corrected, modified, or deleted;
  • Requesting that our Company restrict use of your information;
  • To receive information which you have provided to us in a structured, commonly used and machine-readable format (i.e. CSV file) and the right to have that information transferred to another data controller (i.e. a third-party data controller);
  • To object to the processing of your information for certain purposes (i.e. see the section below entitled "Your Right to Object" processing information for certain purposes);
  • To withdraw your consent to our use of your information at any time where we rely on your consent to use or process personal information. Please note: If you withdraw your consent, this will not affect the lawfulness of our use and processing information on the basis of your consent before the point-in-time when you withdrew your consent.

Your Right to Object to the Processing of Your Information. You have the following rights in relation to your information which you may exercise as outlined in this provision and agreement, by notifying us in writing via email at:  


Information Requests. Users can submit a request regarding their personal information we retain on their account or request a change to personal data on their account by contacting our Data Control Officer via email at: All requests must be in writing and include a verified copy of identification such as: passport; driver license; or government identification card. 

Please include all of your contact information with written requests as well as a copy of your identification for verification purposes. Please allow up to thirty (30) calendar days for responses to requests and changes to account data.


Third-Party websites. Offers from our business partners are made available to visitors and customers through our website.  Visitors may also discover links that allow them to click through our website to third-party sites.

Users acknowledge that these websites will have their own Terms and Privacy Policy Agreements, which each user should read for their own information.  Users understand that our Company has no control over these websites, their policies, or how and when they collect personal information about you.

Limited Liability. As a result, users agree to release our Company from any liability regarding any website they use or access, and our Company disclaims any and all liability or responsibility for the content on these websites.  When users access or visit these websites, they acknowledge it is done at their own risk.


Our Terms of Service and Privacy Policy comply with California's Online Privacy Protection Act. Those terms have been implemented within our Privacy Policy. (BPR Div. 8, ch. 22, ss. 22575-22579).


Supplemental. For visitors and users residing in the E.U. or U.K., our GDPR Policy supplements our U.S. Privacy Policy. Our company only collects information that is necessary for one or more of its legitimate business functions or activities. 

Information Collection. Personally-identifiable information collected includes and is not limited to: name; email address; phone number; and any information necessary for our company to perform its' duties and obligations under our agreements and policies. This information is considered “personal data” as defined by Article 4(1) of the GDPR. 


Our Company reserves the right to change, modify, or alter our Privacy Policy at any time. When changes are made to our Privacy Policy, notice shall be uploaded on our website along with its effective date.


Our Privacy Policy supplements our Terms of Service which contains a mandatory Mediation Clause, with Mediation taking place in San Jose, California, United States of America.  Those provisions and conditions apply to disputes involving our Privacy Policy; Terms of Service; Service agreements and policies.


If any provision of this Agreement is deemed unenforceable, or invalid, the unenforceable or invalid provision shall be deemed modified to the least extent necessary to become legal and enforceable and no other provisions affected thereby. These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, United States of America, excluding conflicts of law or C.I.S.G. provisions.
